Modipro, hereinafter referred to as “Modipro,” treats your personal data with the highest degree of care and confidentiality. It is our priority to inform you about how we process and secure your personal data.

This privacy policy contains information about what personal data Modipro processes from you, the purpose and legal basis for such processing, how Modipro uses this personal data, when it is shared with third parties, the use of processors and what rights you have in relation to your personal data.

This privacy statement applies to:
a) Visitors to Modipro’s websites (www.modipro.nl and www.webshop.modipro.nl), hereinafter referred to as the “Website”;
b) Potential customers and other individuals with whom Modipro contacts, or attempts to contact, via email, an online contact form or by telephone;
c) Recipients of Modipro’s digital newsletters, blogs, promotions, event invitations or commercial emails (hereinafter collectively referred to as Marketing);
d) Customers of Modipro; and
e) All other individuals who contact Modipro and whose personal data Modipro processes.

1. Definitions

In this privacy policy, the following terms are defined as follows:

a) Processor: a natural or legal person, a government agency, a service or another body that processes personal data on behalf of Modipro;
(b) Third party means anyone other than yourself, Modipro, a processor, or any person authorized under the direct authority of the controller or processor to process personal data;
(c) You: the person whose personal data is processed by Modipro;
d) Personal Data: any data relating to you that identifies you, in particular by means of a name, an identification number, location data, an online identifier, or one or more elements that are characteristic of your identity;
e) Consent means any free, specific, informed and unambiguous expression of will whereby you consent to the processing of your personal data through a statement or an unambiguous active act;
(f) Provision of personal data means disclosing or making available personal data; and
g) Processing of personal data means any operation or set of operations involving personal data, whether or not carried out through automated processes, such as the collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, merging or combination, restriction, erasure or destruction of data.

2. When do we receive personal data from you?

Modipro obtains your personal data in the following situations:

a) When you visit the Website;
b) When you fill out a form on the Website, such as, for example, to download an ebook, register for an event, or request a trial version of software;
c) When you contact Modipro, for example, via e-mail, a contact form on the Website, or by telephone;
d) When you sign up for email updates from Modipro; and/or
e) When you provide data to us as part of a customer relationship with Modipro, or other data we obtain from other sources because of this customer relationship.

3. What personal data does Modipro process?

a. Website visits:
During a visit to the Website, our servers automatically store information such as the URL, IP address, browser type (mobile or desktop), and the date and time of the visit. We also record your browsing and clicking behavior during your visit to the Website and link this to your previous and future visits.

b. Contact with Modipro:
When you contact Modipro, for example with a request for information or advice about one of our products, assistance with a product already purchased through the help desk, or registration for a seminar or other event, Modipro processes the personal data you provide to us. This includes contact information provided via email, phone or the contact form on the Website, requests for quotes via the Website, and information provided during introductory meetings, training sessions, consultations, or events organized by Modipro.

c. Marketing (and unsubscribing):
As part of the marketing activities offered by Modipro to its (potential) customers and/or interested parties, we collect personal data. You can sign yourself up for digital newsletters (blogs, event invitations, company and product news), promotional emails and/or 1-on-1 sales emails, and you decide what information you share with Modipro. The (personal) data collected includes first name, last name, e-mail address, company name, phone number and job category. Information marked with * may be required in order to send the marketing materials.

Marketing materials are sent only after Modipro has obtained permission, in accordance with legal requirements. You can always withdraw your consent and/or change your preferences, thereby exercising your right to object. You can unsubscribe (digitally) from the marketing materials and/or change your preferences regarding the marketing, free of charge, with each message, and in a convenient way.

d. Data provided and collected from other sources pursuant to the customer relationship with Modipro
When you purchase a product or service from Modipro, we process the personal data you have provided to us via e-mail, the contact form on the Website, during conversations or in other ways. We process the following personal data: first name, last name, e-mail address, company name, phone number, position, job category and country.

4. Purposes of processing personal data and bases

Optimization of the Website, services, products and information provision:
We use the automatically stored and generated information from the Website (see 3 sub a) to further improve the structure of our Website, our services and products and to optimize the information provision. This data also helps combat fraud. While using the Websites, cookies are also placed on your computer, smartphone or tablet. See section 5 for more information on Modipro’s use of cookies.

Maintaining contact with you:
When you request information from Modipro, we process the personal data provided to fulfill that request and/or to answer your questions.

Execution of the agreement between you and Modipro:
In order to execute the agreement of purchase and/or order between you and Modipro, we need at least your contact and billing information. In addition, in many cases we may need to process other personal data, depending on the type of product and/or service you purchase from Modipro.

Other purposes for using personal data:
Personal data may be used for quality and management purposes, such as internal controls, audits, auditing and evaluations. Sometimes Modipro conducts customer satisfaction surveys and we use your contact information (email address and phone number) to send you a request to participate. We analyze offline and online contact with you, using general data that allows us to identify you. Modipro does not create extensive personal customer profiles (“profiling”).

Foundations:
Personal data will be processed only if one of the following conditions (bases) is met:

You gave your consent to do so;
It is necessary for the performance of a contract to which you are a party;
It is necessary to comply with a legal obligation incumbent on Modipro (in principle, this basis only applies when it comes to meeting tax obligations);
It is necessary to protect the vital interests of you or another natural person (this basis is rare);
It is necessary for the protection of the legitimate interests of Modipro or a third party, unless the interests or fundamental rights and freedoms of you outweigh those of Modipro and/or the third party.

5. Security

Modipro maintains a level of security for processing personal data that is adequate, within the capabilities of current technologies, to prevent unauthorized access, alteration, disclosure or loss of your personal data.

Our customer database is stored digitally and can only be accessed by authorized personnel within Modipro. The customer data database is accessible only through personal login credentials and a secure connection from authorized personnel.

The security of your personal data depends in part on the level of security you yourself maintain. It is therefore important that you exercise care when addressing your emails or correspondence through other channels, and that you ensure the access and security of your email account used for confidential communications with Modipro.

6. Your rights

You have the right to request your personal data from Modipro, have it changed or deleted. However, Modipro may be required by law to retain certain personal data. In such cases, Modipro cannot change and/or delete this data in response to your request.

In certain situations, you also have the right to obtain your personal data, which you have provided to Modipro, in a structured, common and machine-readable form, and you have the right to transfer this data to another party, if the processing by Modipro is covered by the right to data portability as established by applicable laws and regulations.

To exercise these rights, please email info@modipro.nl. Please note that even after we change or delete your personal data at your request, this data may remain in our backups for some time, until these backups are also deleted. If you have unsubscribed, we keep the unsubscription (i.e., not the personal data itself) for 5 years.

7. Third Parties

We do not share your personal data with third parties without your consent, unless:
1. necessary for the negotiation, conclusion, and performance of the agreement between you and Modipro; and/or
2. Modipro is required by a legal obligation or emergency to disclose personal data to government agencies, such as when a court order imposes an obligation to disclose personal data to third parties. Only the data we are legally obliged to provide will be shared; and/or
3. Modipro organizes a training or event in cooperation with a third party, in which case only your contact information will be shared with that third party; and/or
4. in the event of a reorganization or transfer of business activities at Modipro, which may require Modipro to transfer personal data to another organization.

8. Third party privacy statements

Modipro’s privacy policy does not apply to third party websites, even if Modipro has placed a hyperlink or link on its Website to these other websites (e.g., social media). Modipro accepts no responsibility or liability for how these third parties handle personal data and cookies. We advise you to take note of the privacy statements and cookie policies of those websites.

9. Processors

Modipro may engage third parties to process your personal data. These third parties (processors) process your personal data only on our behalf, and we enter into processor agreements with these third parties that meet the requirements of the General Data Protection Regulation. This may include, for example, data cleaning services or service providers providing hosting services.

10. Retention periods

Your personal data will be retained for as long as necessary to fulfill the purposes described in Article 4 of this Privacy Statement. After the (legal) retention period, your personal data will be destroyed.

Modipro keeps your customer information for 5 years after the termination of the agreement or order, or the expiration of your warranty on a product and/or service provided by us. This time period is necessary for the defense in case of a claim against Modipro. At the end of this period, the file is permanently destroyed.

The above retention period does not apply in the event that Modipro is required by law to retain personal data for a longer period.

Marketing Cookies
Marketing cookies are used to link to social media such as LinkedIn and Twitter, for example. These buttons allow website content (for example, our blog) to be shared on social media. The marketing cookies related to social media are not set by Modipro, but by these parties or the party acting on their behalf. 4. Transfer of cookies to third parties

Modipro shares some cookies with third parties, including Hubspot, an online marketing platform. In addition, Modipro also transfers data to third parties outside the European Economic Area (“EEA”), where different protections apply than within the EU. The AVG does not apply in the EEA. Your data may not be as well protected as in the Netherlands.

5. Your rights

Modipro uses cookies to process personal data. You have the right to request your personal data from Modipro or to request Modipro to change or delete it. However, the most appropriate and practical option for you is to delete your browser cookies. Setting your browser differently will stop the processing of personal data, see also point 1 above under “refuse cookies”.
